These Terms of Service apply when you visit Growth Garden, create an account, join a mailing list, place an order or use services made available through our online store. Growth Garden operates in South Africa and can be contacted through our Contact page or at growthgardensa@gmail.com.
Adult customers and child-related information
The online store and customer account services are intended for adults acting as parents, guardians or authorised caregivers. Children should not submit personal information or place orders themselves.
Growth Garden products and guidance
Growth Garden provides educator-designed products and guidance intended to support everyday play, learning and connection. Content is educational and play-based. It is not medical, diagnostic, therapeutic or other professional healthcare advice and does not replace assessment or advice from an appropriately qualified professional.
Adult supervision and safe use
Products for babies and children must be used with suitable adult supervision and in accordance with the age guidance, warnings and instructions supplied. The supervising adult remains responsible for deciding whether an activity is appropriate for the individual child’s abilities and circumstances, and for keeping small parts and other hazards away from children for whom they are unsuitable.
Accounts are not orders
Creating an account or child profile does not create an order, start fulfilment or authorise payment. You are responsible for providing accurate information and protecting access to your email and account. Contact us if you believe an account has been used without permission.
Purchase options
Growth Garden has two planned purchase paths:
- Complete 10-Box Journey: the only planned recurring subscription option, covering all ten boxes across Seed, Sprout, Branch, Sapling and Mighty Tree. There are no three-month or six-month subscription plans. The final price, billing dates, delivery schedule and cancellation terms must be shown before a recurring arrangement is authorised.
- Once-Off Age-Stage Box: one box, one payment and no automatic continuation. You may start with the age-stage box that fits your child.
Joining a mailing list does not create an order or subscription. A recurring payment may only apply after clear disclosure and active customer authorisation.
Prices, orders and payment
Prices are displayed in South African rand (ZAR) unless checkout clearly states otherwise. Applicable taxes are included where the store indicates this. Delivery charges, discounts and the total payable are displayed before you place the order. An order enters fulfilment only after successful payment and acceptance. Failed or incomplete payment must not create a fulfilment-ready order.
Pre-orders
Products offered on pre-order will display relevant launch or dispatch information before payment. By ordering, you agree to that disclosed window. If a material delay or inability to supply occurs, Growth Garden will communicate the available remedy in accordance with applicable law.
Product descriptions and substitutions
We aim to describe and display products accurately. Minor differences in colour, packaging or arrangement can occur because of screens and production. A component may only be substituted where necessary for availability, safety or age-appropriateness, with the aim of preserving the intended developmental purpose and overall value, and subject always to applicable consumer rights. A material change will be communicated where required.
Delivery, returns and refunds
The Shipping Policy and Refund Policy form part of these terms. Nothing in these terms removes any statutory cooling-off right, implied warranty, right to safe and good-quality goods, or other protection that cannot lawfully be excluded.
Reviews and community content
Growth Garden publishes genuine customer or tester feedback only where appropriate permission and verification have been obtained. You must not submit unlawful, abusive, misleading or rights-infringing content. We may moderate or remove content where reasonably necessary.
Intellectual property
Growth Garden names, branding, mascots, illustrations, written materials, activity designs, downloadable resources, photographs, videos and other original content are protected by applicable intellectual property law. They may not be copied, reproduced, sold, redistributed or commercially exploited without permission except where the law permits.
Acceptable use
You may not use the website to break the law, interfere with store operation, attempt unauthorised access, submit malicious code, misuse another person’s information or infringe the rights of Growth Garden or another person.
Third-party services
The store may rely on third-party services such as Shopify, payment providers, couriers, email services and social platforms. Their own terms and privacy practices may apply to the parts of the service they provide.
Liability and mandatory consumer protections
Nothing in these terms excludes or limits liability or consumer rights where doing so would be unlawful. To the extent permitted by law, Growth Garden is not responsible for loss caused by circumstances outside its reasonable control or by use of a product contrary to supplied safety guidance and instructions.
Changes and applicable law
We may update these terms as our products, services and legal requirements change. The version presented at the time of your transaction applies together with any product-specific terms shown before payment. These terms are governed by the laws applicable in South Africa, subject to mandatory consumer protections.
